The MCCA Seminar Series No 3: Alternative Dispute Resolution
The Malaysia Corporate Counsel Association (MCCA) in collaboration with KLRCA continued efforts to enlighten the in-house legal practitioner fraternity in the area of Alternative Dispute Resolution (ADR) by holding its third talk under the MCCA Seminar Series that explores ADR techniques in the Malaysian and International contexts.
With the KLRCA gaining an international reputation as a regional arbitration centre, and, new legislation such as the Construction Industry Payment and Adjudication Act 2012 coming into force, there is a need for Malaysian counsel to be familiar with the full range of ADR techniques available and to have an insight into how they can be used effectively.
The session commenced with an opening address and introduction by Mr Thavakumar Kandiahpillai, President of The Malaysia Corporate Counsel Association (MCCA), who thanked the attendees for braving the heavy downpour and for turning out in numbers. Mr Kuhendran Thanapalasingam, (Partner, Zul Rafique and Partners) soon took the floor to begin his headlining talk on ‘Recent Developments in International Arbitration.’ The enterprising talk incorporated various new issues that have come into play on the international arbitration scene. Two high profile cases were brought up to provide the attendees with a lucid understanding of the matter; Case one being “Thai-Lao Lignite Co. Ltd & Anor v Government of the Lao People’s Democratic Republic” and the second case being “PT First Media TBK (Formerly Known as PT Broadband Multimedia TBK) v ASTRO Nusantara International BV & 7 ORS.”
This was soon followed with KLRCA’s Deputy Head of Legal Services, Ms Lai Jen Li taking stage, presenting on ‘KLRCA Rules and its Recent Revision’ to ensure everyone in attendance was up to speed with the timely developments closer to home. The final section of the seminar was taken up by a panel discussion encompassing the topic, ‘Commencing and Managing Arbitration the KLRCA Way.’ This enthralling session that comprised of renowned subject matter experts; Mr Thavakumar Kandiahpillai (President of MCCA), Ms Stephanie Chin (Head, Legal Affairs and Commercial Division of Sarawak Energy Berhad [SEB]), Ms Rammit Kaur (Former Head of Legal Services KLRCA) and Ms Lai Jen Li herself was moderated by Mr Revantha Sinnetamby, a General Counsel of a Malaysian listed company.
An engaging discussion subsequently followed with each of the speakers sharing real world experiences pertaining to various aspects of managing international arbitration. The seminar came to a fitting end when one of the attendees, His Excellency Mr Krit Kraichitti, Ambassador of Thailand concluded proceedings with a brief sharing session on Thailand’s past arbitration affairs.
