Where the arbitration is not administered by an arbitral institution, the Parties typically manage the arbitration themselves. The AIAC however offers Parties various services in these circumstances, such as acting as an appointing authority, and fundholding services. The Director of the AIAC acts as the default appointing authority under the Malaysian Arbitration Act 2005 [Act 646].

Agreements administered by the UNCITRAL Arbitration Rules

The AIAC acts as an appointing authority and administering authority to assist Parties and/or Arbitral Tribunals who have agreed to have the arbitration administered in accordance with the UNCITRAL Arbitration Rules 2021. The AIAC has designed a Protocol to assist Parties and/or Arbitral Tribunals in this regard. By adoption of the Protocol, Parties are deemed to accept the AIAC as the designated appointing and administering authority of the arbitration.
