In the end, whether a dispute is international or domestic, in the courts or arbitration, between individuals or companies, comes down to what’s at stake. More often than not, it’s money! In arbitration, the tribunal is tasked with the job of awarding monetary or declaratory relief. This session zooms into the former. With quantum experts, their role is to assist the parties and the tribunal in determining the value of such monetary relief. This valuation is done by using one of the various approaches available to experts, including the income approach, market approach, and cost or asset-based approach. Expert evaluations, however, are not just crucial for the tribunal, but also for counsel in advising their clients. The valuations produced by an expert also provide counsel with the information needed in forming their strategies to tackle the dispute during hearings.
In this session, we will hear from experts on how they determine what the best approach is to adopt and the manner in which they make their findings translatable to a tribunal. Additionally, the speakers will discuss how counsel and arbitrators use the valuations from experts and how it serves in advising clients and ultimately, in deciding the dispute.
