Banks and financial institutions are of utmost importance in maintaining economic activity and enabling the supply and delivery of basic needs for the population in times of crisis. Nevertheless, the banking and finance industry is not immune to the advent of disputes. Traditionally, such disputes have been resolved by litigation as opposed to arbitration or other alternative dispute resolution mechanisms; however, globalisation and the increased participation of players from emerging markets in the world of finance may mean that the post-COVID-19 era will see an increase in the use of arbitration to resolve banking and finance disputes. In this webinar, the panel will consider the arbitrability of banking and finance disputes, particularly in the context of Capital Markets and Islamic Finance, as well as international finance, whilst also considering alternatives to arbitration for aggrieved parties.
