Earlier this year, a stop-work order was issued for a partially collapsed block of a luxury condominium project in the Klang Valley, which collapse was suspected to be due to structural failures. This incident is not alone in its fault. In 2016, a half-completed 70m long pedestrian link bridge connecting two reputable commercial developments collapsed, killing one and injuring five workers. Elsewhere, in 2018, the bridge collapse in Genoa, Italy, raised awareness of the catastrophic consequences for failing to maintain bridges. Structural failures, building fires, and other various construction disasters can cause massive disruptions not only in work but in the livelihood of the workers, tenants, and community. It is no question that disputes surrounding the loss of human life must be handled differently than those of delay and defects that don’t result in disaster. But the question remains who is to be held responsible for such liability and how are such disputes handled? This panel will discuss the various issues regarding liability insurance and what it covers, what duty is owed to the public to release the findings of investigations, along with the various means by which such disputes can be resolved.
