Join us this 6th November 2019 (Wednesday) as we bring you an evening talk on, "Singapore Convention on Mediation: Can Mediation Finally Challenge Arbitration?".
On 20th December 2018, the United Nations General Assembly passed a resolution to adopt the UN Convention on International Settlement Agreements Resulting from Mediation (the "Convention"). The signing ceremony for the Convention was held in Singapore on 7th August 2019. This brings to fruition three years of discussions with participation of 85 member states and 35 international organisations.
The Convention is aimed at facilitating the enforcement of settlement agreements which arise out of mediation and has been touted as mediation's equivalent of the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards.
Over the years, mediation has undoubtedly grown in popularity as a means of resolving disputes in the region. Will the advantages afforded by the Convention result in substantive decline in arbitrations?
