KLRCA Talk Series : Bias in Arbitration
The whole purpose of any legal proceedings, whether arbitration or court hearing, is defeated if one of the parties believes that an arbitrator or judge is biased against him. This seminar will examine how courts have considered the issue of bias in these circumstances, and extend to the important topic of natural justice
Robert Rhodes QC, Outer Temple Chambers, London
Robert Rhodes QC has specialised in many areas of practice over a long time, both in the UK and abroad, with a particular interest in mainland China, Hong Kong and the Middle East. He has rights of audience in the Dubai International Financial Centre, and is a member of the Dubai International Arbitration Centre. He is a Fellow of the Chartered Institute of Arbitrators, a member of the Corporate Panel of the Dispute Board Federation, of the London Court of International Arbitration and of the International Chamber of Commerce. He has been appointed Advisor of the Financial Arbitration and ADR Center of the Central University of Finance and Economics, Beijing. He holds a Diploma in International Arbitration, and is an accredited Mediator. He has been appointed to the panel of mediators of CCPIT (China Council for the Promotion of International Trade). He has been appointed to the panel of mediators and arbitrators of the Lang Fang Arbitration Commission in China. He has been appointed to the Panel of Arbitrators of the Thai Arbitration Institute. He is also arbitration counsel. He has extensive experience of chairing disciplinary tribunals, including for the Investment Managers’ Regulatory Organisation, the Accountants’ Investigation and Discipline Board, and the Financial Reporting Council. He has considerable judicial experience, extending over 30 years. He is a Master of the Bench of the Inner Temple, and a member of the Bar Council of England and Wales.
Ivan Loo
Partner, Skrine
Ivan graduated from the University of Bristol, United Kingdom and thereafter called to the Bar of England and Wales (Gray’s Inn). In 1992, he was admitted as an Advocate & Solicitor of the High Court of Malaya. He is a Partner in the Malaysian law firm of Skrine where he heads the Construction and Engineering Practice Group. He is currently the Immediate Past President of the Society of Construction Law (Malaysia), Vice President of the Malaysian Society of Adjudicators, a Fellow of the Chartered Institute of Arbitrators (UK) and a committee member of the Arbitration and Alternative Dispute Resolution Committee of the Bar Council, Malaysia.
A significant portion of his past and present work involves the construction industry where he appears primarily as lead counsel in arbitration and/or litigation proceedings and also in the drafting and reviewing of construction related contracts. Ivan also sits as arbitrator in both international and domestic arbitrations and is on the panel of arbitrators of the Kuala Lumpur Regional Centre for Arbitration. He is also an accredited mediator with the Malaysian Mediation Centre.
