KLRCA Talk Series: Increasing the time and cost efficiency of arbitration – is the German Approach v
Increasing the time and cost efficiency of arbitration has become a major concern of the users of arbitration and, as a consequence, a challenge for arbitrators and arbitral institutions. This talk will provide attendees with a view on Civil Law, mainly German procedural law instruments fostering the efficiency of dispute resolution, such as early and ongoing assessment of the merits, promotion of settlements and a more managerial role of arbitrators. It will discuss whether and to which extent such features of the German approach can and should be used in an international context. It will also deal with the argument, often raised in Common Law arbitration communities, that a managerial approach of the arbitration tribunal would imply bias and, hence, should be discarded.

In 1993, Axel Reeg has established REEG RECHTSANWAELTE, a niche law firm active in cross-border arbitration and litigation and business transactions with associated offices in Kuala Lumpur (RaslanLoong) and Madrid.
Holding a Ph.D. in law and admitted to the Bars in Germany and Spain, Axel also lectures International Commercial Arbitration at the University of Heidelberg. Axel has extensive experience in dispute resolution, both as an arbitrator (primarily ICC and DIS), as counsel in international arbitration and before state courts.
Axel is a member of the Board of Trustees of the CIArb, a member of the Advisory Board of the Heidelberg International Dispute Resolution Center, the chair of the German/Austrian chapter of the Club Español de Arbitraje, a vice chair of the Arbitration Committee of the IPBA and a Past Chairman of the CIArb European Branch. Axel is also a member of ICCA, IBA, DIS, ASA and the Latin American Association for Arbitration.

Kuhendran Thanapalasingam is a partner in the Dispute Resolution practice group. He holds a Bachelor of Laws (Hons) degree from the University of Leicester, United Kingdom. He is a Solicitor of the Supreme Court of England & Wales and was admitted as an Advocate & Solicitor of the High Court of Malaya in 1992. He is also a Fellow of the Chartered Institute of Arbitrators.
Kuhendran is involved in arbitration and litigation, particularly in construction and engineering related disputes. Apart from his experience in dispute resolution, he has also advised on different aspects of construction and engineering law. In addition, he has drafted and vetted various construction and engineering related contracts.
