Welcome to KLRCA's digital newsletter December edition. Following the success of 2017 and our continuous effort in shaping KLRCA as an international institution, KLRCA will change its name to Asian International Arbitration Centre (AIAC) as of 2018. We are very much looking forward to our new identity as it is a milestone that signifies a new era of expansion of us to provide the best possible services and innovative solutions, from Asia to the globe.

KLRCA Belt & Road Conference 2017 - Cross Border Investments and Its Legal Consequences: ADR in Belt and Road

On 9th December, KLRCA and the China-ASEAN Legal Cooperation Center (CALCC) co-hosted the "Belt and Road Conference 2018 on Cross Border Investment and its Legal Consequences: ADR in Belt and Road", at Bangunan Sulaiman. Over 100 delegates from around the world came together in Kuala Lumpur that day to discuss the key issues and challenges facing the Belt Road Initiative, the indispensable role arbitration institutions plah in the Belt Road Initiative, and the Various alternative dispute resolution (ADR) mechanisms available to overcome Belt Road disputes. All participants also saw the keynote speech delivered by the Chief Justice of Malaysia, Yang Amat Arif Tun Md. Raus Sharif. 

 

Managing Domain Name Disputes in a Transforming Cyberspace

The current rising trend in e-commerce has led to an increase in the number of domain name registration worldwide. In Malaysia, as of September 2017, there was a total of 327,109 ".my" domain names registered. With the implementation of ICANN's generic Top Level Domain (gTLD) programme, hundreds of new gTLDs are now up and running in the cyberspace. The best way to tackle online infringements in relation to these new gTLDs has become a matter of great concern to many intellectual property (IP) rights owners. In order to settle such disputes in a more resourceful manner than litigation, a party may turn to an alternative solution offered by the Domain Name Dispute Resolution (DNDR) providers, such as KLRCA.

CIPAA Refresher Course

On 19th December 2017, the KLRCA launched its first full-day CIPAA Refresher Course which covered all recent legal developments in relation to the construction industry adjudication landscape in Malaysia. The event was proceeded with a opening speech delivered by Datuk Professor Sundra Rajoo, director of KLRCA. A full house of 200 professionals attended the event, witnessing a line up of distinguished industry experts who presented their insights on up-to-date judicial precedents, updates on counterclaims/LAD and procedural discrepancies. A second edition of this course will be held on January 11, 2018 at KLRCA and the registration is open. Asia No Longer "Third" to Third Party Funding - Meets the Financing World of Arbitration (Kshama Loya Modani & Vyapak Desai)

Access to justice laid the foundation stone for third party funding (TPF) in litigation, nearly seven centuries ago. while TPF has attained sufficient degree of stability in the United Kingdom (UK), Australia, United States of America (USA) and few European countries, it is gaining momentum in Asia. Traction, however, is being seen in the realm of arbitration as against traditional litigation. On January 9, 2017, Singapore accorded statutory recognition to TPF in international arbitration subject to regulation. In Hong Kong, consultation on TPF for arbitration has culminated into a report of the Law Commission on October 12, 2016, recommending TPF in Hong Kong- seated arbitration and services provided in Hong Kong for foreign-seated arbitration. Commercial eyes are set on Hong Kong as it endeavors to open doors to TPF in 2017.
