States worldwide are adopting tough measures to tackle the COVID-19 pandemic and keep their economies afloat. While such responses will pursue important public policy aims, these measures will create unprecedented risks for foreign investors. Significant questions arise about the interaction of foreign investment protections under international investment agreements and COVID-19 measures by States. While investment tribunals recognise the discretion by States in response to public health issues, government actions in response to COVID-19 may violate foreign investment protections if they are discriminatory or disproportionate.
