Across the globe, the protection of intellectual property (“IP”) rights has led to some of the most contentiously fought disputes in courts, many of which last for years, resulting in significant legal costs. In Asia, the applications for IP registrations has increased each year, and has led to a surge in IP disputes. Recent trends show arbitration becoming a more popular and preferred mechanism for the resolution of IP disputes. Although traditionally it is thought that IP arbitration is restricted to only certain types of disputes concerning IP rights, some jurisdictions have instituted mandatory arbitration proceedings aimed at a more expeditious disposition of IP disputes.
