Conflict, Claims and Construction Disputes: Adjudication Leading the Way
Addressing the legal issues that may come up in one of the most important sectors of the Malaysian economy, the construction industry, this lecture will analyse alternatives that are provided for the stakeholders in the marketplace to resolve and prevent disputes. Contractual interpretation and payment disputes, among others, are very common in this area and likely to multiply in the future as the market share grows.
In specific, we will talk about two main subjects. First, the adjudication of construction disputes. Adjudication is the premier ADR for payment disputes as it has proven to be remarkably fast and low-cost. We will review the main concepts and provide an idea of the procedural steps. Second, the strategic prevention of disputes by adhering to form contracts. Our efforts to reduce disputes in construction have led us to creating a series of form contracts to provide an even standpoint for all participants. We will analyse the forms and explain how they function.
