Seminar: The Impact of Building Information Modelling (BIM) on Dispute Resolution
A joint talk between Kuala Lumpur Regional Centre for Arbitration and King’s College London Alumni Malaysia (KCLAM)
The rapid increase in the adoption of “Building Information Modelling (BIM)” raises new legal questions that demand urgent attention. In addition to protection of cyber-security and intellectual property , BIM also challenges fundamentally the traditional consultant/contractor roles in relation to design contributions and critical path activities. “4D” modelling through BIM enables the mapping of all parties’ input at every stage of a project. If used properly, BIM could radically reduce the scope for delay and disruption disputes , but for the unwary it could mean exposure to much greater liability. In this lecture, Professor David Mosey will explain his recent work for the UK Government in trialling BIM on live projects and his research as to the impact of BIM on the resolution of time-related disputes.”

Professor David Mosey PhD (Director,Centre of Construction Law and Dispute Resolution, King’s College London)
Professor David Mosey PhD is Director of the King’s College London Centre of Construction Law and Dispute Resolution, part of the Dickson Poon School of Law, and is former Head of Projects and Construction at Trowers & Hamlins solicitors.
With over 30 years’ experience advising on building and infrastructure projects in the UK and the Middle East, David is described in the Chambers Guide to the Legal Profession as a “partnering guru” who “gives something to the industry”. He is principal author of the PPC2000, TPC2005 and PPC International partnering contract forms. David and his team at Trowers & Hamlins won the UK Builder and Engineer “Construction Law Firm of the Year” 2011, and David won the UK Constructing Excellence “Achievers Award” 2009.
David jointly led the UK Government “National Change Agent” team from 2005 to 2011, using regional consortium procurement to secure substantial cost savings, more energy efficient designs and over 500 new apprenticeships on housing programmes. He is currently “project mentor” on several UK Government “Trial Projects”, testing implementation of new procurement and delivery models geared to early contractor involvement, collaborative working and effective implementation of Building Information Modelling.
David is author of “Procurement and Delivery Guidance Using Two Stage Open Book and Supply Chain Collaboration”, launched by UK Secretary of State Vince Cable in July 2014 and available on the Cabinet Office website. He is currently leading a new research project at King’s investigating the potential for construction contract processes and provisions to facilitate “Building Information Modelling”.
YA Datuk John Louis O’Hara (Judge of the High Court of Malaya)
Y.A. Datuk John Louis O’Hara completed his upper secondary education at the Royal Military College Sg. Besi after which he proceeded to read law at King’s College, London obtaining his LL.B Hons in 1974.
He is a barrister from Lincoln’s Inn and having completed his Post Final Practical Training was called to the English Bar in 1976. Upon his return he joined the Judicial and Legal Service and served inter alia as a Magistrate, Sessions Court Judge, Deputy Public Prosecutor, Senior Federal Counsel, Industrial Court Chairman and Advisory Board Chairman. He has also served as Legal Advisor with the Ministry of Defence (1988 – 1992) and with the Ministry of Foreign Affairs (1994 – 1999). He was called to the Malaysian Bar in 1994. His last posting was as Head of the International Affairs Division of the Attorney-General’s Chambers. He has been a member of the Malaysian delegation to numerous bi-literal meetings and multilateral conferences and regularly attended the Sixth Committee of the UN as well as Law of the Sea Meetings. He was appointed a Judicial Commissioner on 1.9.2005 and elevated as a Judge on 5.9.2007. He is currently Judge at the NCVC in the Kuala Lumpur High Court.
